In short: OrcStat is sold by Trifecta Labs LLC. Payments are handled by Paddle, our reseller and merchant of record. You can try Pro Personal free for 14 days, cancel at any time, and get a full refund within 14 days of your first payment. If a subscription ends, the app switches to read-only mode and your data stays yours.
1. Who we are
OrcStat is software made and sold by Trifecta Labs LLC, a limited liability company organised in Delaware, USA ("we", "us", "our"). In these terms "OrcStat" means the desktop app, the browser version, the account portal at app.orcstat.com and this website.
You can reach us at [email protected].
2. Accepting these terms
By creating an account, starting a trial, buying a subscription or using OrcStat, you agree to these terms and to our privacy policy and refund policy. If you use OrcStat for an organisation, you confirm that you may accept these terms on its behalf. You must be at least 16 years old, or the age of digital consent where you live if that is higher.
Institutions that sign a separate agreement with us are covered by that agreement where it differs from these terms.
3. Payments through Paddle
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the merchant of record for all our orders. Paddle takes your payment, charges any sales tax or VAT that applies, issues your invoices and receipts, and handles payment questions and refunds. When you buy, you also accept Paddle's buyer terms.
Prices are shown in US dollars before tax. Tax is added at checkout where it applies.
4. Plans
- Pro Personal: one person, active on up to 2 devices. $50 a month billed annually ($600 a year), or $60 billed monthly.
- Pro Team: for groups of 3 or more seats, each active on up to 2 devices. Prices are listed on the pricing page.
- Institution: seats or a site licence on a quote we agree with you in writing.
Every plan includes every statistics module. We may change what a plan includes or costs in future. Price changes apply from your next renewal, and we will tell you by email before they do.
5. Free trial
You can try Pro Personal free for 14 days. No card is needed. There is one trial per person; we may refuse or end a trial that we reasonably believe is a repeat trial, for example one tied to the same email address, domain or device. When the trial ends, OrcStat switches to read-only mode unless you have subscribed.
6. Beta offer
The first 500 people to sign up during the beta get Pro Personal free for 6 months. Near the end of that period we invite them to subscribe at 40% off Pro Personal ($30 a month billed annually, or $36 billed monthly). That price stays for as long as the subscription stays active. If you cancel and subscribe again later, the normal price applies. One beta place per person. The offer can't be combined with other discounts.
7. Student discount
Students can ask for a single-use code worth 60% off Pro Personal monthly. We review each request by hand and may ask for proof of enrolment. The discount lasts for as long as the subscription stays active; if you cancel, the code is used up and you need to ask again. It can't be combined with the beta offer. We may refuse a request or remove a discount that was obtained with false information.
8. Subscriptions, renewal and cancellation
- Subscriptions renew automatically at the end of each billing period (monthly or annual) until you cancel.
- You can cancel at any time from your account. Cancelling stops the next renewal. You keep full access until the end of the period you have paid for.
- If a payment fails, Paddle will retry it and we will email you. If it still fails after the grace period, OrcStat switches to read-only mode until payment is made.
9. Refunds
You can get a full refund within 14 days of your first payment for a subscription. Renewal payments are not refunded. Refunds are processed by Paddle back to the original payment method. The full details are in our refund policy. This doesn't affect any rights you have under the consumer law of the country you live in.
10. Read-only mode
When a trial ends, a subscription is cancelled or a payment fails, OrcStat switches to read-only mode. You can still open, view and export your projects and .sav files, but you can't run new analyses or use the AI features. We never lock your data away. Subscribing again restores full access at the next licence check, with nothing to reinstall.
11. Your licence to use OrcStat
While your trial or subscription is active, we give you a personal, non-exclusive, non-transferable licence to install and use OrcStat for the number of seats you have paid for, each on up to 2 devices at a time. You can move a seat to a different device by signing out of one of the others.
The app checks your licence when it's online and keeps working offline for up to 30 days between checks. After 30 days without a check, it switches to read-only mode until it can check again. What a licence check sends is described in our privacy policy.
OrcStat is licensed, not sold. We and our licensors keep all rights not expressly given to you.
12. Acceptable use
You agree not to:
- share your account, or let more people or devices use OrcStat than your plan allows;
- get around, disable or interfere with the licence check, the device limit or read-only mode;
- copy, resell, sublicense or rent OrcStat, or reverse engineer it except where the law allows it despite this restriction;
- use OrcStat to break the law or the rights of others, including data protection law and the terms under which you hold your data;
- attack, overload or probe our services, or create accounts with false information or by automated means.
We may suspend or close an account that breaks these rules. Where we reasonably can, we will tell you first and give you a chance to fix the problem.
13. Your data and your results
Your datasets, projects, syntax and output belong to you. The statistics engine runs on your device, or in your browser for the browser version, and we don't receive the data you analyse. The AI features only talk to model servers that you configure. You are responsible for having the right to use the data you analyse and for keeping your own backups.
14. Third-party software and models
OrcStat can connect to AI models and servers you choose, such as Ollama or LM Studio. Those are provided by others under their own terms, and we are not responsible for them. OrcStat includes open-source components, which are covered by their own licences.
15. Statistical results
We test OrcStat carefully, but no software is free of errors. You are responsible for checking that an analysis suits your data and question, and for decisions you make based on its results. AI explanations and drafts are aids and should be reviewed before you rely on them. OrcStat is not affiliated with IBM; SPSS is a trademark of IBM Corp.
16. Warranty disclaimer
To the extent the law allows, OrcStat is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.
17. Limitation of liability
To the extent the law allows, neither we nor our suppliers are liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of OrcStat. Our total liability for any claim relating to OrcStat is limited to the amount you paid for it in the 12 months before the claim arose. Nothing in these terms limits liability that can't be limited by law.
18. Ending these terms
You can stop using OrcStat and close your account at any time by emailing [email protected]. We may end these terms or close your account if you seriously break them. If we stop offering OrcStat altogether, we will give you reasonable notice and refund any prepaid fees for the time remaining. Sections 13 to 17 and 20 continue after these terms end.
19. Changes to these terms
We may update these terms. We will post the new version here and change the "last updated" date. If a change materially affects you, we will tell you by email at least 30 days before it takes effect. If you don't agree, you can cancel before then.
20. Governing law
These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules. Any dispute will be heard by the state or federal courts located in Delaware, unless the consumer law of the country where you live gives you the right to bring a claim where you live.
21. Contact
